Opening
Today we are going to learn one narrow sugya, but we are going to learn it all the way down. The question is not whether one may use a particular electrical appliance on shabat. It is not whether one may turn on an incandescent bulb, run a heating element, cook with an electric coil, start a motor that performs some separate melakha, record sound, write data, illuminate a display, print a page, charge a battery, magnetize metal, perform electrolysis, or create a spark. Every one of those cases has its own halakhic output, and some of those outputs fit familiar melakhot very readily. If we mix those results into the present inquiry, we will never discover what electricity itself is.
Our question is more exact. Suppose there is a completely assembled electrical kli, a finished utensil, designed from the beginning to be switched on and off. Suppose that closing its switch produces no incandescent glow, no spark, no significant heat, no stored charge that we wish to preserve, no sound, no writing, no recording, no visible light, no motion, and no other independently classifiable result.
The only relevant change is hibur hamaagal hahashmali, closing the electrical circuit, followed by hakhnasat zérem, introducing electrical current, into a path prepared for that purpose. Is that activation itself a melakha, prohibited creative labor, on shabat?
That artificial case is essential. In ordinary life electricity nearly always does something, and the thing it does may decide the law. But a sugya is tested by isolating its variables. We are removing every downstream effect so that the alleged intrinsic prohibition must stand on its own feet.
If one says the act is mavir, kindling, one must show that current itself has the halakhic form of havara, kindling a fire. If one says it is boneh, building, one must identify the binyan, the construction, accomplished by the switch. If one says it is soter, demolishing, when the switch is opened, one must identify the structure that is dismantled. If one says it is makeh bpatish, the final hammer blow, one must identify the gmar melakha, completion of a manufactured object. If one says it is molid, producing a new property, one must show that the Gemara's rabbinic cases authorize that analogy.
And if one retreats to uvdin dhol, weekday-form activity, one must define that category from its sources rather than using it as a synonym for anything that feels modern.
This is an analytic shiur. It is not a practical ruling for the operation of ordinary appliances. The ordinary practice of observant communities is to prohibit direct intentional electrical activation on shabat, and actual devices introduce many facts that our ideal case excludes. Our purpose is to ask a prior question: what, in the language of the Gemara and the categories of halakha, is the current itself?
Part One. the Burden of Classification
The Mishna in Shabat 7:2, and the Bavli on Shabat 73a, give the list of the thirty-nine avot melakhot, primary classes of prohibited labor. Electricity is obviously not named, but that fact alone proves almost nothing. The Gemara did not name a laser printer, a thermostat, a sewing machine, or a refrigerator either.
A new technology may perform an old melakha. The point of the list is not to freeze halakha in antiquity. The point is that a new act becomes prohibited as melakha only by entering an established legal class.
Shabat 49b connects the number and identity of the melakhot to the work of the Mishkan, the Tabernacle. Bava Qamma 2a explains the relationship between an av and a tolda, a derivative labor. A tolda is not merely something new, useful, strenuous, or technologically powerful. It is an act that possesses the halakhic resemblance to an av. Rambam, Hilkhot Shabat 7:5, makes this method explicit: derivatives are acts that resemble the avot. The comparison can turn on the nature of the action, the nature of the result, or the constructive purpose recognized by the category, but there must be a principled resemblance.
That gives us the first rule of the sugya. Novelty is not a melakha. Energy is not a melakha. Activation is not a melakha. Utility is not a melakha. A technological revolution is not a fortieth av. The question is always mishum mai, under which established ground, is the act prohibited? If there is no av, no valid tolda, and no established shevut, rabbinic shabat prohibition, the intensity of our intuition cannot manufacture one.
At the same time, a meqorist analysis must not cheat in the opposite direction. It cannot say, electricity is absent from Shabat 73a, therefore electricity is permitted. That would erase the entire law of toldot. A meqorist method is source-bound, not primitive. It asks whether the proposed classification can be derived with the same kind of legal comparison that the Gemara itself uses.
It demands a legal address. It does not demand an ancient noun for a modern machine.
There is another preliminary point. The phrase melakhet mahshevet, deliberate constructive craftsmanship, tells us that shabat liability concerns legally significant, purposive labor. It helps define attribution, intention, and the identity of an act. It does not create an open category called important technology.
One cannot first fail to identify any melakha and then say that because the act is intelligent and useful, melakhet mahshevet turns it into one. Melakhet mahshevet refines a classified melakha; it does not replace classification.
So the burden is disciplined. The stringent side does not need the word electricity in the Gemara, but it does need to show a valid av, tolda, or sourced rabbinic extension. The permissive side does not need a special heter, permission, written for electrons, but it must answer the strongest proposed classifications. The heter, if it emerges, will be the cumulative failure of the issur, prohibition, theories in the stipulated case.
Part Two. What Exactly Changes When the Switch Is Closed?
Before opening the sefarim, we need to prevent an equivocation that has haunted this discussion. Three different things can be called the electrical act.
The first is the mechanical act. Two contacts touch, a lever moves, or a semiconductor gate changes condition. If the claim is boneh because two pieces are joined, then the object of classification is the switch hardware.
The second is the electrical state. An electric field is established through the conductive path and charge carriers drift. If the claim is mavir or molid because a new force has appeared, then the object of classification is the zérem or the newly active electrical condition.
The third is the functional state of the appliance. A device that was not presently operating becomes presently usable for its intended output. If the claim is tiqun mana, repair or functional completion of a utensil, or makeh bpatish, then the object of classification is not necessarily the metal contact or the electrons. It is the status of the whole machine.
These are not the same argument. A response that says electrons are not created answers one version of molid, but it does not yet answer the claim that a new functional state has been produced. A response that says the switch is designed to open and close answers a physical construction claim, but it may not yet answer a theory of functional completion. A response that says the appliance becomes useful addresses the whole machine, but it may prove too much, because opening a water faucet also makes a plumbing system presently useful.
The whole shiur will therefore return to one question: what is the hefza, the legally classified object, and what is the maase, the legally classified human act? Is the hefza the conductor, the circuit, or the appliance? Is the maase joining, creating, completing, or merely using? Until those coordinates are fixed, words such as construction and creation conceal more than they explain.
Now add one piece of modest physics. Closing an ordinary circuit does not create electrons. Conductors already contain mobile charge carriers.
The switch changes the electrical boundary conditions and allows an electric field to be established through the path; charge then drifts. In alternating current, the direction of motion repeatedly reverses, and the instantaneous current passes through zero every cycle. None of that decides halakha, because halakha can classify a new functional state even when physics says no new substance was created.
But it warns us against treating electricity as a fluid-object that suddenly comes into existence inside an empty wire. A legal theory may use ordinary human experience, but it should not rest on a false physical haqira, conceptual premise.
Part Three. Why the History of the Technology Changed the halakhik Theories
The opinions about electricity do not form a random encyclopedia of rabbinic names. They fall into conceptual periods, and those periods track both the machines that posqim, halakhic decisors, saw and the scientific language available to describe them.
In the late nineteenth and early twentieth centuries, the most natural experience of electricity was a new ko'ah, force or potency, entering an object. Electrical systems often involved telegraph wires, telephone transmitters, exposed contacts, carbon granules, arcs, sparks, filaments, and machinery in which electrical action was both dramatic and poorly separated from heat and fire. The early molid theory belongs to this world. Rabi Yizhaq Shmelkes, in Bet Yizhaq, Yore Dea volume two, Hashmatot to siman 31, discusses the telephone and treats circuit activation as molid ko'ah, bringing a new active power into the apparatus. That is a state-or-substance theory: the wire or device acquires a potency it did not possess in its inactive condition.
Some early discussions also use mavir because the apparatus actually produced a spark or heated material. Rabi Avraham Yizhaq Kook, in Orah Mishpat, Orah Hayim 71, writes about a microphone arrangement and speaks of an electric spark. The historical hardware matters.
It is not fair to portray every early poseq as confusing electrons with flame. Some were classifying the sparks, arcs, or heated components of the devices before them. The mistake comes later, if a ruling about actual sparking apparatus is generalized to silent solid-state current with neither spark nor heat.
By the middle of the twentieth century, the conceptual center moved from invisible force to circuit structure. The Hazon Ish, Orah Hayim, Hilkhot Shabat 50:9, framed closing the electrical path as boneh or tiqun mana. His language emphasizes placing the wire and appliance into an operative condition, often summarized as bringing the object from death to life. This is a circuit-and-object theory.
The key claim is not that electrons are fire and not merely that an invisible substance has been generated. It is that the act gives a constructed system its operative form.
Rabi Shlomo Zalman Auerbach represents a postwar engineering-and-use analysis. The central discussions are in Minhat Shlomo, first volume, simanim 9 through 12, not siman 74. His attention shifts to the design of the kli. If the apparatus is completely manufactured and its switch exists precisely for repeated activation and deactivation, the off state is not brokenness and the on state is not repair. The switch is a control. Current is the intended medium through which a finished utensil is used. This theory attacks both the language of boneh and the broad extension of molid.
The digital and semiconductor era sharpened the problem again. A contemporary device may contain billions of microscopic state changes, many of them continuous, automatic, imperceptible, and not separately wanted by the user. If every electrical state transition is boneh, molid, or makeh bpatish, then a person may be performing vast numbers of constructive and destructive acts without any perceptible result.
Later posqim therefore distinguish direct intentional activation with a significant desired output from hidden internal changes with no humanly significant result. Rabi Asher Weiss, even while building a strong makeh bpatish theory for meaningful activation, limits that theory where electronic changes are unnoticed and have no visible or otherwise perceptible utility for the person. Rabi Nahum Rabinovitch and his students place still greater weight on the concrete human act, the intended outcome, and whether the event has the form of a melakha at all.
This historical map is not a genetic fallacy. We are not saying an early position is wrong because it is early, or a later position is right because it uses newer science. We are identifying the point of each sevara, conceptual argument.
Bet Yizhaq asks about producing potency. The Hazon Ish asks about making a system functional. Rabi Shlomo Zalman asks whether on and off are modes of use in an already finished kli.
Rabi Asher Weiss asks whether a significant creative act needs a narrower av-specific resemblance at all, or whether makeh bpatish can gather it. Once we see those questions, we can test arguments rather than count authorities.
Part Four. maveer: Is Zarem itself havara?
We begin with the simplest candidate because it can be disposed of most cleanly in our stipulated case. Mavir is not a metaphysical category for all energy. It is the melakha of kindling. Rambam, Hilkhot Shabat 12:1, includes heating metal until it glows because the metal itself reaches a fire-like incandescent condition.
The classic electric light bulb therefore raises a real havara question: its filament becomes intensely hot and luminous. An electrical arc or spark may raise another. But our test case excludes glowing metal, spark, flame, and halakhically significant heat.
If current passes silently through a conductor that remains below any relevant temperature, what is the esh, the fire? The mere movement of charge is not combustion, flame, spark, coal, or glowing metal. To call it mavir because electricity can cause fire is like calling flowing water bishul, cooking, because hot water can cook. A causal medium does not inherit every melakha it is capable of performing.
This is where the distinction between electrical input and appliance output is decisive. If current heats an element, analyze the element. If it creates a spark, analyze the spark. If it cooks food, analyze bishul. But if all outputs are removed, zérem itself supplies no hefza of fire. The intrinsic mavir theory therefore fails in the pure case, not because modern science overrules halakha, but because the defining halakhic phenomenon is absent.
One might answer that halakhic fire is broader than scientific fire. True. Halakhic categories do not always match laboratory definitions. Glowing metal proves that.
But broader is not boundless. The extension to glowing metal is grounded in intense heat and incandescence, the very qualities our case removes. A category can have halakhic contours different from physics without losing all contours.
The historical sources should therefore be read with precision. When rabi Kook speaks of the electric spark in a microphone, his object of discussion is a spark. Later writers who read him as making all current a Torah-level havara must prove that generalization. Conversely, posqim who ruled broadly in an era of filament and spark devices may have been describing the devices then before them. For the isolated zérem case, mavir is the weakest intrinsic theory.
Part Five. boneh and soter: Does the Switch Build A Functioning klee?
Now we reach the deepest Torah-level argument. Boneh is attractive because something undeniable happens when the circuit closes: the system becomes operative. If construction can be functional rather than architectural, perhaps the switch really does build.
The Mishna on Shabat 102b teaches that building even a small amount can be liable. The same unit discusses chiseling, drilling, and makeh bpatish, and it gives the general condition that a melakha-result must have endurance. Elsewhere, especially Shabat 47a, the sugyot of assembling and disassembling utensils distinguish between a serious, tight construction and loose, routine assembly. The later halakha codifies important differences among permanent joining, firm joining, loose insertion, and ordinary use.
The Hazon Ish's theory can be stated in its strongest form as follows. Before the circuit is closed, the apparatus is incapable of its designated work. After the circuit is closed, all of its components form one effective system and the kli can perform its function. The human being has not merely placed fuel near a finished object.
He has completed the operative relationship among its parts. The current unites the circuitry into a functional whole. That is tiqun mana, making or repairing a utensil, and therefore boneh.
If the current is interrupted, the operative structure is undone; that is soter, dismantling.
There are really two strands inside this theory. One is physical hibur, joining. The switch brings contacts together and closes a path. The other is functional hibur.
Even if the components do not visibly move, current converts an inert arrangement into a working machine. The second strand is more powerful, because many modern switches have no meaningful manual assembly. A transistor may change state without two macroscopic pieces being fitted together.
If the theory depends only on metal touching metal, semiconductor switching escapes too easily. If it depends on functional construction, the theory can follow the technology.
The phrase from death to life captures the intuition. A stopped clock, a disconnected machine, or a circuit without current can seem like a body lacking its animating force. Winding a mechanical watch was treated stringently by some aharonim, later authorities, as tiqun mana, because the act gives the mechanism the power to function. The electrical switch appears analogous: the user confers operative life.
We should not caricature this. Boneh does not require pouring concrete. The halakha of keli binyan, construction in utensils, recognizes that making a tool work can be construction. Nor is temporariness an automatic exemption.
Some temporary constructions remain prohibited, at least rabbinically, and sometimes biblically depending on their form. The serious argument is that a circuit is an integrated functional arrangement and that activation gives the arrangement its presently complete form.
But now comes the anti-boneh analysis, and its first question is brutally simple: what was broken?
The device in our case is completely assembled. Every wire is fixed. Every component is installed. The switch is not a loose replacement part waiting to be attached. It is part of the completed utensil, and the manufacturer intends the user to move it repeatedly. Off is not a defect in the kli. Off is one of the kli's designed states.
On is not a repair. On is another designed state. The device remains the same complete utensil on both sides of the switch.
That is the force of derekh tashmish, the ordinary mode of use. Rabi Shlomo Zalman argues that admitting current through a finished system resembles opening the passage for water, gas, or air in an apparatus designed to control a flow. Opening a faucet does not construct the pipe. Closing it does not demolish the plumbing. Opening a door does not build a doorway in the open position, and closing it does not build a wall in the closed position. The moving part mediates use of an existing structure.
At this point the debate is not physics against halakha. It is a dispute over the status of the off state. The Hazon Ish treats lack of current as functional incompleteness.
Rabi Shlomo Zalman treats it as quiescent completeness. If a fan without current is a broken fan, activation repairs it. If it is a complete fan presently at rest, activation uses it. The same metal can be described through two legal models.
How do we decide between them? Start with recurrence. A switch is designed for hundreds or thousands of cycles. The user who turns it on ordinarily intends to turn it off. Then perhaps to turn it on again. If every on is boneh and every off is soter, the artifact is being constructed and demolished again and again in the course of its normal use.
Halakha can recognize repeated construction; a collapsible structure does not become automatically permitted because it is reusable. But repetition is powerful evidence of the manufacturer's and user's conception. It suggests that the states are use modes, not manufacture and destruction.
Next consider bodily change, tiqun begufo shel keli, repair in the body of the utensil. The current does not reshape the device, add a missing component, tighten a loose joint, or improve the substance of the kli. When the current ceases, no repair remains.
The entire result is coterminous with continued power. That looks less like building an object and more like operating it.
Then consider the symmetry problem. If closing the circuit is boneh because the object becomes useful, opening must be soter because usefulness ceases. Yet users often turn a device off in order to preserve it, control it, or prepare it for its next use.
That act is constructive in ordinary purpose, not destructive. Soter can be liable when done for the sake of building, so constructive purpose does not eliminate soter. But the conceptual strain is telling. The theory must say that routine control of a finished machine alternates between a structure and its demolition even though the physical artifact remains whole.
The strongest reply for the Hazon Ish is that legal construction is about functional integration, not the user's vocabulary. A sectional bed tightly assembled for use can be boneh even if the owner calls the act setup. A switch completes a conductive network.
The fact that the manufacturer expects later disconnection may affect permanence but not erase the present structure. The operative circuit endures for as long as the machine is meant to run, and that may be enough.
The answer is that ordinary control is not merely a label either. The sugyot distinguish assembly from using an already assembled object. A door repeatedly rotates on its hinges; a faucet repeatedly changes the condition of flow; a valve makes a system operative and inoperative.
If present functionality alone is construction, every controlled pathway becomes a building site. The category requires a principled line between completing a kli and selecting a mode in a completed kli.
Rabi Ovadia Yosef, in Yabia Omer, first volume, Orah Hayim 20, expresses the anti-boneh intuition in terms of a complete kli and derekh tashmisho, its mode of use. Rabi Shlomo Goren also rejected the circuit-as-boneh model. Their inclusion is not a vote count. It shows that the derekh tashmish argument is a recognized halakhic classification, not a modern technological excuse.
We can sharpen the haqira with test cases. Imagine a bare circuit that was physically severed and a person solders the wire together. That is a genuine act of construction or repair, quite apart from current.
Now replace the solder with a plug designed to be inserted once and left indefinitely. The permanence and assembly features increase. Now replace it with a wall switch designed for daily use.
The physical joining becomes ordinary control. Now replace the switch with a transistor whose conductive state changes electronically, with no macroscopic joining at all. If all four cases are called boneh for exactly the same reason, the real theory cannot be physical joining. It must be functional activation. Once that is admitted, the faucet and door analogies become unavoidable.
Another test: suppose a current is already flowing and the user increases its intensity. If boneh means the first formation of a functional circuit, increasing current should be easier. If boneh means each acquisition of greater useful capacity, every adjustment may become additional building. Some authorities do extend concern to substantial changes in electrical function, while others permit a decrease or change in intensity precisely because no new circuit is born. The nafqa mina, practical difference, reveals the underlying theory.
One more test: suppose two parallel paths already conduct current, and a switch transfers the load from one to the other without changing the visible output. Is the second path newly built? If yes, the hefza is each conductive arrangement.
If no, because the appliance was functional throughout, the hefza is the whole device. Either answer can be argued, but the poseq must choose. One cannot shift between the conductor and the appliance whenever convenient.
Our interim judgment is therefore measured. The Hazon Ish supplies a serious and sophisticated Torah-level theory: functional circuit completion can be tiqun mana and boneh. It is not defeated merely by saying electrons are invisible or that the switch is small. But in the pure case of a finished utensil designed for recurrent on-and-off control, the derekh tashmish model is closer to the classical distinction between construction and use.
The utensil is not repaired in its body, no manufactured state endures after the current stops, and the switch selects an operating condition for an already complete kli. On a Gemara-centered analysis, boneh is not established.
Soter falls with that conclusion. If opening the switch merely ends use of a completed circuit rather than dismantling a constructed object, there is no soter. If one accepts the Hazon Ish's boneh premise, however, one must analyze disconnection as soter and then ask about destructive purpose, preparation for rebuilding, and level of liability. The soter question is derivative. Its fate depends on what we decided was built.
Part Six. makeh bpatish: Can Importance itself Supply the melakha?
The next candidate resembles boneh but must not be collapsed into it. Makeh bpatish is the finishing act, the stroke that completes an article or brings a craft to its final state. On Shabat 102b, the Mishna places it beside building and chiseling. On Shabat 75b, the Gemara repeatedly asks whether a particular act is liable because of makeh bpatish, and the underlying idea is gmar melakha, the completion of work.
That gives a straightforward electrical argument. The appliance may be physically assembled, but until it is activated it cannot do what it was made to do. Closing the circuit is the last act between a finished-looking shell and an effective instrument. It is the final blow in function rather than in manufacture.
Tzitz Eliezer, volume six, siman 6, presents a strong metaqen-makeh bpatish approach. Current is the active power that carries the machine. Introducing it confers the decisive operative condition.
More systematically, rabi Asher Weiss, in Minhat Asher on Shabat, first volume, siman 30, turns to the Yerushalmi in Shabat 7:2. The Yerushalmi says that rabi Yohanan and Resh Laqish studied the chapter of the melakhot for three and a half years. Every act they could affiliate with an av they affiliated; what they could not affiliate they placed under makeh bpatish. Rabi Asher Weiss reads this as evidence that makeh bpatish has a general role: a highly significant, constructive, creative act may fall within it even when it does not resemble one specific av in the narrow manner of an ordinary tolda.
This is perhaps the strongest response to the meqorist demand for a legal address. It says: the address is makeh bpatish, and the Yerushalmi itself authorizes that address for important creative work that escapes the other boxes. Electrical activation is not a trivial movement of a button. It actualizes a system, unlocks controlled energy, and in modern life makes possible the activity of civilization. The fact that it is effortless does not matter; many melakhot require little physical exertion. The fact that it is novel does not matter; makeh bpatish is precisely the class that receives significant finishing acts.
Notice the elegance of this theory. It does not claim that current is fire. It does not depend on imagining electricity as a substance. It does not need the switch to be a permanent wall. It classifies the human act according to its creative significance: a dormant engineered system is brought into effective operation.
But the theory faces two textual limits. The first is the Bavli's repeated connection of makeh bpatish to finishing. The act is not a residual container for anything impressive. It is gmar melakha.
If a potter taps a vessel at the end of manufacture, the blow completes the article. If a craftsperson performs the final defining operation, the artifact moves from unfinished to finished. When an owner presses the ordinary on button of a fully manufactured device, no manufacture ends. The user begins consumption of the kli's service. The act is first use, not final fabrication.
The stringent answer is that completion can be functional and present-tense. The machine may be complete in inventory status but incomplete for its present purpose. Each activation actualizes the engineered potential.
The response is that this threatens to convert every act of use into completion. Opening an umbrella completes its present shelter function. Opening a book completes its present readability.
Turning a key completes the lock's securing function. Pouring water into a cup makes the cup presently useful for drinking. Halakha needs a line between finalizing the instrument and deploying the instrument.
The second limit is the relationship between the Yerushalmi and the fixed structure of the avot. The Yerushalmi's statement can mean that makeh bpatish receives craft-finishing acts that lack a more specific affiliation. It need not mean that any socially important innovation is a melakha. The scholars were classifying acts in the chapter of shabat; they were not announcing an unrestricted judicial power to add all significant labor to the thirty-nine. The Mishkan framework and the av-tolda method remain.
The distinction between the importance of an invention and the importance of a user's motion is especially important. Electricity as a civilizational achievement is extraordinarily creative. But the engineer who designs a circuit and the factory that manufactures it do not perform the same act as the consumer who uses its switch.
One cannot transfer the creativity of Nikola Tesla, Michael Faraday, or the semiconductor designer into every finger movement of the end user. The legal maase is the user's activation, not the historical invention of electricity.
Here the later writing of rabi Asher Weiss supplies an internal limiting principle. In Minhat Asher, first volume, siman 32, he distinguishes significant intended circuit activation with a perceptible desired result from automatic internal electronic changes whose utility and result are not apparent to the person. In those hidden cases, he says there may be no trace of melakha and no melakhet mahshevet.
That limitation is intellectually important. It concedes that circuit state alone is not enough. The act needs a humanly significant functional result.
For our ideal case, however, we deliberately removed perceptible output. If the only fact is zérem in a completed conductor and no result is seen, heard, stored, moved, heated, or otherwise desired apart from the abstract electrical condition, the later limitation weakens the makeh bpatish argument sharply. The theory becomes strongest when the device does something significant, but then the analysis may belong to the output we excluded, not to current intrinsically.
We can formulate a decisive nafqa mina. Suppose a person closes an isolated laboratory circuit hidden in a box. A tiny current circulates, produces no useful data, and causes no perceptible change. Has a great creative act occurred? If makeh bpatish attaches to zérem itself, the answer must be yes. If it attaches to meaningful actualization of a useful system, the answer is no. The first answer makes the category depend on an imperceptible physical state; the second concedes that electricity alone is not the melakha.
Another test concerns constant digital switching. A powered processor changes conductive states millions or billions of times each second. If every significant conductive path is a new gmar melakha, the machine performs innumerable makeh bpatish events continuously.
That may be possible for the machine as an automatic process, but it reveals that circuit closure cannot itself be the decisive human category. The user's legally relevant act must be framed at the level of intended function.
Our conclusion is therefore similar to, but distinct from, the boneh conclusion. Rabi Asher Weiss offers a formidable policy-and-category response to a novel creative technology, grounded in the Yerushalmi. Yet the Bavli's gmar melakha structure and the ordinary distinction between making a tool and using it make it difficult to call routine activation of a completed reusable kli the final hammer blow. In the outputless test case, the argument loses the perceptible significant result that gives it much of its force. Makeh bpatish is not established as an intrinsic classification of zérem.
Part Seven. molid: Is A New Electrical State A New Thing?
Molid is historically the most influential intrinsic theory, and also the one most often stated too loosely. We must begin by locating it correctly. Molid is not one of the thirty-nine avot. In the electrical discussion it is a proposed shevut, not a Torah-level melakha. The question is whether several Talmudic prohibitions involving the production of a new quality form a general rabbinic category broad enough to include electrical activation.
On Beitza 23a, the Gemara discusses placing fragrance into material. Rashi explains the concern as molid reha, producing a fragrance, because one places a new scent into the object, and the production of something new resembles a new melakha. On Beitza 33a, the Mishna prohibits producing fire on Yom Tov from stones, wood, dust, or water, and the Gemara's explanation uses the language of molid, bringing forth a new thing.
On Shabat 51b, the Gemara prohibits crushing snow or hail into water. Rashi explains that the person produces water, while other rishonim, early authorities, and Rambam in Hilkhot Shabat 21:13 understand the concern through resemblance to squeezing. On Eruvin 104a, Ulla initially objects to producing sound, but Rava limits the prohibition to musical sound. These sugyot reveal both the attraction and the danger of the word molid.
The attraction is obvious. In each case a person takes an existing object or materials and brings about a state that feels new: scent in a garment, fire that was absent, liquid water from ice, sound. Electricity appears to fit the pattern. A dead wire becomes electrically active.
The device acquires a new useful property. Bet Yizhaq therefore analogizes telephone activation to molid reha and speaks of molid ko'ah. He is not required to believe that electrons are created ex nihilo. His legal point can be reconstructed as functional acquisition: the wire and apparatus now possess an active potency they lacked.
State the pro-molid case at full strength. First, the new property is real. A conductor under potential and carrying current behaves differently from the same conductor at rest. Second, the property is useful. It enables the apparatus to perform its designated task. Third, the property is introduced by the user's act.
Fourth, halakha sometimes treats the creation of a quality within an existing object as molid even though no new substance has been formed; fragrance is the paradigm. Therefore, the absence of newly created electrons is irrelevant. The new electrical condition is the tolda-like novelty.
There is also a cautionary policy beneath the analogy. The Sages prohibited certain acts that look like generating a new usable entity even when they do not match an av melakha. Electrical activation is a quintessential production of usable power. Calling it molid places a modern event inside an existing rabbinic sensibility rather than inventing a fortieth Torah category.
Now the critique. The first problem is doctrinal breadth. The Gemara never announces a general rule that producing any new property is forbidden. Its molid cases are local and uneven.
The snow case itself is explained differently by major rishonim. The sound proposal is restricted. Rambam does not organize a universal molid chapter covering every useful state change. If we abstract from fragrance, fire, ice, and sound a free-standing prohibition on novelty, ordinary shabat life becomes impossible.
Mixing ingredients creates a new flavor. Opening curtains creates light in a room. Turning a manual valve creates pressure and flow. Wearing a garment warms it. The legal system needs the limiting features of the original cases.
The second problem is perceptibility. Fragrance is sensed and remains within the material. Fire is visible and independently present. Melted water is a tangible state.
In our pure electrical case, the zérem is not itself visible, audible, tactile in a permitted sense, or otherwise perceptible. Rabi Natan Levin, the son-in-law of the Bet Yizhaq, argued early that molid reha concerns a quality grasped by the senses, whereas electrical current is not perceived by any of the five senses. His view is cited in Zelah Hehadash, Quntres Aharon to maamar 1, and approvingly discussed in Tzitz Eliezer, volume one, siman 20, chapter 10. Rabi Yaaqov Schorr made a similar argument: the comparison works when the novelty is recognizable, not when the alleged new state has no sensory manifestation.
Perceptibility is not a magical rule found in one sentence of the Gemara, but it identifies why molid reha is a manageable category. The garment has acquired a humanly experienced property. If the only novelty is known through an engineer's instruments, the analogy is much weaker. And if the appliance produces a perceptible light, sound, image, motion, or heat, we have left the pure case and must analyze that result separately.
The third problem is duration. The scent adheres to the garment for a meaningful period. The current exists only while the circuit remains supplied. When the switch opens, the condition vanishes without leaving the conductor improved. Transience by itself does not always permit a shabat act, but the combination of transience, imperceptibility, and designed recurrence makes the state look like operation rather than production.
The fourth problem is that the kli was built precisely to alternate between these states. Rabi Shlomo Zalman, in Minhat Shlomo I.9, argues that a routine, repeatedly produced, tran-zee-unt operating condition should not be assimilated to molid reha. He emphasizes the difficulty of creating a new molid prohibition not established in Shas, the Talmudic corpus. At the same time, he speaks with practical caution because the Bet Yizhaq had already ruled stringently.
That caution must not be erased, but neither should it be converted into agreement with the theory. His textual analysis undermines the blanket molid claim.
The fifth problem comes from the physics. Closing a switch does not create the electric charges. It establishes conditions under which existing charges move.
The pro-molid side can answer that the new legal property is current flow, not electrons. Fair enough. But then the analogy is no longer to creating a thing. It is to initiating a process. Water flowing in a pipe is also a process initiated by a valve. Gas moving through a line is a process. Mechanical rotation begun by releasing a brake is a process. Why is electrical flow uniquely called a new entity?
One possible answer is that electrical power enters and animates the entire device, while water merely passes through. Yet that description depends on the appliance output. In an outputless circuit, the current is simply a controlled physical flow.
In a useful appliance, the useful animation may be light, heat, sound, motion, or computation, each requiring its own analysis. Molid cannot win by borrowing the salience of excluded results.
The sixth problem is internal consistency across changes in intensity. If molid occurs only when current begins from zero, then increasing an existing current should be easier because no new category has appeared. This distinction appears in later discussions of volume control, hearing aids, and variable current. It makes sense under the Bet Yizhaq model: the first current produces the new potency, while a quantitative adjustment does not.
But modern electronics complicate zero and nonzero. Devices maintain standby currents, bias currents, leakage currents, and rapidly alternating paths. If a microscopic current already exists, has all later activation escaped molid?
If not, then molid means useful state change rather than first current, and the doctrine must say so.
A further conceptual criticism says that the electrical power is already generated or prepared by an active system, so the user does not produce the source. Modern grid physics makes the spatial picture more complex, but the legal intuition remains useful. The consumer opens a path to an already functioning system. The act may be causally indispensable, yet it resembles drawing from a prepared source rather than manufacturing the source.
The pro-molid side has a sophisticated response. A fragrance source may already exist, but inserting scent into the garment produces a new quality in this garment. Similarly, even if the grid is active, this circuit acquires a new operative property. The reply returns us to the decisive disanalogy: the garment retains a perceptible quality, whereas the finished circuit merely operates while the control admits current.
There is a deeper legal issue here. Can a later poseq extend a rabbinic prohibition by sevara, conceptual analogy, when the Sages did not enact a general gezerah, decree? Of course halakha applies rabbinic categories to new facts.
Otherwise no rabbinic law could survive technological change. But application is not legislation. The closer the new case shares the defining features of the source case, the more it is application. The more we abstract the source into a broad policy such as no new useful state, the more we risk making a new gezerah.
A meqorist method therefore asks what features carry the Talmudic molid cases: perceptible novelty, an acquired quality in an object, some meaningful persistence, and a form the Gemara itself marks as rabbinically labor-like. Pure zérem in a repeatedly switched, completed conductor has none of those features strongly. It is invisible in the stipulated case, leaves no property behind, is expected to cease, and is a mode of operation. The analogy is possible, which explains its historical authority, but it is not compelled.
Our interim conclusion is that molid is more plausible than mavir as a historical intrinsic theory and less structurally strained than calling the switch a new wall. Yet its legal level is rabbinic, its Talmudic basis is local rather than general, and its fit depends on converting tran-zee-unt current into a newly acquired property. In the pure case, the anti-molid arguments prevail.
Part Eight. Rabbi Shlomo Zalman: What He Accepted, What He Rejected, and What He Did Not Say
Because this sugya is often narrated inaccurately, we need one clean source-control interlude.
Rabi Shlomo Zalman Auerbach did not write his main intrinsic electricity analysis in Minhat Shlomo siman 74. The core material is in the first volume, simanim 9 through 12, especially siman 9 on telephone and molid, siman 10 on electrical current and results in appliance cases, and siman 11 in the exchange surrounding the Hazon Ish's boneh model.
His textual logic is powerful. He rejects the idea that ordinary current is automatically fire. He rejects the routine activation of a finished, repeatedly controlled appliance as ordinary boneh or makeh bpatish. He sharply limits molid and says it is difficult to create a molid prohibition without a Talmudic foundation. He compares electrical admission to ordinary control of prepared flows and treats the electrical result, rather than electricity as a universal substance, as the place where a defined melakha may arise.
But two exaggerations must be avoided. First, he did not issue a blanket practical heter for switching ordinary appliances. His responsa contain caution, deference to prior rulings, and restrictions in actual cases. Second, one should not attribute to him a formal doctrine that all nonmelakha electricity is prohibited solely as uvdin dhol. In the telephone discussion, the practical reservation includes concern about how ordinary people will understand or extend a permission, but that is not the same as defining the intrinsic act as uvdin dhol.
This distinction matters for intellectual honesty. One may use rabi Shlomo Zalman's analysis to argue that the proposed melakha categories fail without pretending that his practical pesaq, legal ruling, was a general permission. Conversely, one may follow his practical restraint without rewriting his lomdus as agreement with boneh or molid. The analytic and practical layers are related but not identical.
Part Nine. uvdin dhol: A Separate sugyah, Not A Substitute melakha
Suppose we have concluded that intrinsic current is neither mavir, boneh, makeh bpatish, nor a convincing molid. Can we simply say that switching electricity is nevertheless uvdin dhol?
The first answer is categorical: uvdin dhol is not a melakha. If it applies, it is a separate rabbinic restraint or a shabaton obligation, a mandated form of sabbath-rest. It cannot answer the narrow question, is zérem itself a melakha? At most it answers the later practical question, may the act nevertheless be prohibited?
The second answer requires definition. Rambam, Hilkhot Shabat 21:1, describes shevut categories as acts that resemble melakha or may lead to melakha. In Hilkhot Shabat 24:1, he discusses weekday pursuits and speech based on Yeshayahu 58:13, distinguishing shabat conduct even where an act does not directly resemble a melakha. Ramban on Vayiqra 23:24 develops the broad mitzva of shabaton: without a general duty to rest, a person could spend the day moving merchandise, measuring grain, filling barrels, and conducting laborious affairs while evading the thirty-nine formal melakhot.
The broad objection is serious. Electricity is the infrastructure through which modern weekday civilization acts. If every electrical act were technically outside melakha, a person could recreate the factory, office, market, studio, and entertainment system on shabat. Rabi Yaaqov Ariel presses this shabaton concern strongly. He describes electricity as foundational to the modern world of labor. On that view, excluding every electrical activation from shabat would preserve the legal shell and empty the day of its character.
But a source-bound definition must distinguish the medium from the weekday labor-form. The same current can sustain a hearing aid, a medical monitor, a clock, a security system, a toy, an industrial press, or a stock exchange terminal. Electricity has no single social form.
It is more like controlled power than like commerce. The Ramban's person spends the day in hauling, measuring, production, and business. The wrong lies in the labor-system and tirha, burdensome exertion, not in the molecular composition of the tool.
Rambam's responsum 306 supplies a valuable limiting principle. He rejects the idea that everything commonly done on weekdays is automatically prohibited, because eating, drinking, and ordinary human activity also occur on weekdays. Uvdin dhol needs a sourced relationship to prohibited labor, an occupational or commercial form, a risk of leading into melakha, or another defined shabat concern. It is not a free-floating veto on whatever belongs to modern life.
This is the meqorist position in one sentence: uvdin dhol means a sourced weekday labor-form, not weekday technology as such.
That formulation does not erase Ramban's broad shabaton. It disciplines its use. Operating factory machinery, doing one's profession, running a store, processing a work queue, or performing large-scale weekday production can violate shabaton even if a clever automation removes one formal hand action. Pressing one silent control in an outputless test circuit has none of those features merely because electrons move.
The first clear explicit attribution of nonmelakha electricity to uvdin dhol is not rabi Shlomo Zalman. Rabi Yosef Eliyahu Henkin is the earlier antecedent for the no-melakha premise. In Edut LeYisrael, pages 151 through 153, he analyzes a circuit without filament or spark and does not classify the electron motion as melakha, although his practical posture remains stringent. Rabi Nahum Eliezer Rabinovitch, his student, reports the received practical line in Melumdei Milhama, siman 56, and in siman 57, around page 176, explicitly defines the remaining prohibition of direct electrical activation as uvdin dhol.
Even rabi Rabinovitch's formulation is not a decree that any presence of zérem is weekday activity. He rejects the authority to invent a blanket gezerah against every electrical device and analyzes concrete cases by whether the human act resembles melakha, produces a prohibited result, or leads toward one. His students, rabi Eli Reif and Dror Fiksler, use that framework in the sensor debate. The result is a nuanced position: intentional direct switching may take the form of uvdin dhol, while an ordinary permitted act that incidentally causes an imperceptible sensor transition may lack that form entirely.
Some authorities reject the uvdin dhol classification from the stringent direction. Rabi Yisrael Rozen says it is too indeterminate to serve as the systematic basis of electrical law, either to prohibit or to permit. He prefers concrete classifications such as boneh, makeh bpatish, or molid, and he describes the Rabinovitch school as a minority approach. Rabi Eitam Henkin likewise challenges broad sensor leniencies.
Rabi Yaaqov Ariel says the shabaton structure is more fundamental than a thin, case-by-case uvdin category. Rabi Asher Weiss avoids relying on a weak weekday-activity label by reconstructing significant activation as makeh bpatish.
Others reject or narrow uvdin dhol from the category-control direction. Rabi Shlomo Zalman's general discussions, collected in Shulhan Shlomo 306:16.5, relate uvdin dhol to acts connected with melakha or another shabat prohibition rather than to any efficient modern convenience. Rabi Moshe Feinstein, in Igrot Moshe, Orah Hayim volume four, siman 74, Tohen paragraph 4, associates the category with professional or occupation-style weekday work, not every domestic labor-saving instrument. Rabi Dov Linzer, in a contemporary responsum on the Seiko Spring Drive watch, states in that narrow setting that the generated electricity presents neither uvdin dhol nor molid.
These positions do not yield a blanket permission for electrical switching. They establish a more precise proposition: the bare fact of electrical current does not automatically bear the legal form of weekday labor. Context may supply uvdin dhol. Zérem alone does not.
The clean taxonomy is therefore this. One camp says there is an actual technical prohibition, such as boneh, makeh bpatish, or molid, so uvdin dhol is unnecessary or inadequate. A second camp says pure current is not melakha, but direct deliberate activation is ordinarily prohibited as uvdin dhol; this is chiefly the Rabinovitch line. A third approach says uvdin dhol is contextual and cannot attach to electricity as a physical phenomenon; one must identify the professional, commercial, burdensome, melakha-like, or melakha-leading form. Rabi Shlomo Zalman belongs in the technical critique of blanket melakha theories, not as the formal founder of the second camp.
Part Ten. the Five hakirot Under the Entire sugyah
We can now step back. The arguments sound different, but five haqirot govern almost all of them.
The first haqira is whether halakha classifies substance, state, process, or function. Mavir normally classifies a substance or condition of fire. Molid classifies a newly acquired state or quality. Boneh classifies a constructed relationship. Makeh bpatish classifies functional completion. If we say electricity is a process, the mavir and molid language weakens.
If we say the appliance acquires a function, boneh and makeh bpatish strengthen. Every argument must disclose which level it uses.
The second haqira is whether the hefza is the circuit or the entire kli. If the circuit path is the object, each branch that becomes conductive may be newly completed. If the entire appliance is the object, a path change inside an already functioning appliance may not change its legal completeness. Modern electronics force this choice because a single device contains countless circuits that change state while the user experiences one stable object.
The third haqira is whether function equals completion. The stringent theories tend to say that a kli unable to perform its present task is incomplete in the relevant respect. The permissive theories distinguish manufacturing completeness from operating status.
A parked car is complete though not moving. A closed book is complete though not being read. A dark but intact lamp is complete though not illuminating.
The dispute is not over whether function begins. It is over whether beginning function has the legal name tiqun.
The fourth haqira is whether recurrence proves tashmish. If an act is designed to be reversed and repeated as part of ordinary control, that fact strongly suggests use. But halakha sometimes prohibits recurrent assembly.
The question is whether recurrence is merely an intention about duration or evidence that the artifact's very identity includes both states. A folding chair is a chair precisely because it moves between folded and open states. An electrical switch may likewise define the appliance's modes rather than its existence.
The fifth haqira is how far a rabbinic analogy may expand. Molid and uvdin dhol are not mechanical lookups. They require judgment.
A source-bound method cannot deny judgment, but it demands limiting criteria. Perceptibility, persistence, acquired quality, occupational form, tirha, resemblance to melakha, and realistic tendency toward melakha are possible criteria. The phrase this feels like weekday technology is not.
These haqirot explain why the science matters but never decides the sugya alone. Science tells us that charge already exists, that current is a process, that semiconductor switching may involve no moving contact, and that digital systems change state constantly. Halakha decides whether a process can nevertheless count as a newly acquired legal state, whether function is construction, and whether significance can be completion. Correct physics removes false premises. It does not replace legal classification.
Part Eleven. the Strongest Objections To the heter, with Answers
Let us now argue against our emerging conclusion as strongly as possible.
Objection one: surely the Torah cannot permit the act that powers the entire modern world. A conclusion that pure electricity is no melakha is self-refuting because it would turn shabat into a weekday.
Answer: that argument may justify a practical shabaton policy, but it cannot identify an intrinsic melakha. Halakha often separates a physical medium from the prohibited acts performed through it. Speech can conduct business, command a machine, or study Tora; speech is not one legal category. Water can cook, extinguish, irrigate, or simply be drunk; water is not one melakha.
Electricity can perform nearly every melakha, but that versatility is a reason to inspect its result, not to make the medium a universal melakha. The character of shabat remains protected by the actual melakhot, sourced shevut categories, muktzeh, restrictions on handling set-aside objects, commercial restrictions, tirha, shabaton, and device-specific facts. One need not falsify the intrinsic classification to preserve the day.
Objection two: the switch undeniably joins two contacts. Joining is boneh.
Answer: some joining is construction, some is fastening, and some is ordinary movement within a completed utensil. A door contacts its frame, a lid contacts a vessel, and a faucet's internal valve seals an opening. The Gemara's assembly sugyot examine firmness, permanence, and the form of making a kli. Our switch is installed precisely to move. If the contact itself is soldered, repaired, or fitted permanently, analyze that physical act separately. The stipulated routine switch does not become binyan merely because surfaces touch.
Objection three: even without physical joining, the machine goes from dead to alive. Functional creation is more important than material movement.
Answer: the phrase dead to alive is rhetorically powerful but legally loaded. The machine is not dead in the sense of destroyed or broken. It is off. A complete instrument can be quiescent. The proof is that no craftsperson is called when it is switched off, no component must be repaired, and the user expects immediate repeated operation. If every transition from inactivity to activity is making a kli, winding, releasing, opening, and supplying any prepared medium become construction. The classical category needs an act of making or repair, not merely a useful beginning.
Objection four: the Yerushalmi assigns otherwise unclassified important labor to makeh bpatish. Electrical activation is the paradigm of important creative labor.
Answer: the Yerushalmi must be read inside the chapter of the thirty-nine melakhot and alongside the Bavli's gmar melakha. It can establish makeh bpatish as the general av for finishing craft, not a license to prohibit any consequential innovation. More fundamentally, the importance of electricity as a technology is not identical to the craft content of pressing a prepared control.
In our outputless case, the user's act creates no perceptible result. Rabi Asher Weiss's own distinction between significant wanted activation and hidden valueless electronic change shows that bare circuit transition is insufficient.
Objection five: molid reha proves that a new quality in an existing object may be rabbinically forbidden. The circuit now has electrical potency. The analogy is direct.
Answer: it is an analogy, but not a direct identity. Fragrance is perceptible, absorbed into the object, and meaningfully persistent. Pure current is a tran-zee-unt process in a conductor designed for it. The broader claim that every new useful state is molid has no manageable Talmudic boundary. The differing explanations of melting ice and the rejection of generalized sound-production show that molid is not a universal code of novelty. Applying a rabbinic source requires its defining features; abstracting it into no new states risks a new decree.
Objection six: perhaps the current is not perceptible directly, but its existence can be measured. Halakha recognizes invisible realities.
Answer: certainly. Lack of visibility does not make a fact unreal or irrelevant. Perceptibility enters here not as ontology but as the proposed boundary of the molid analogy and the significant-result theory. Halakha can classify an invisible state when a source category fits it. What it cannot do is use the invisible state's reality as proof of a category that has not yet been established. Measurement proves current. It does not prove scent, construction, or completion.
Objection seven: the current endures for the entire time the device runs. That is sufficient permanence.
Answer: duration is relative to the claimed melakha. A tent erected for a short period may still have legal significance. But current does not endure as a constructed result; it continues only through continuous supply.
More important, the circuit was made to alternate. Duration alone cannot distinguish a building from a controlled process. A faucet may run for hours without the water flow becoming a structure.
Objection eight: normative pesaq treats electrical switching as prohibited. A source analysis reaching no intrinsic melakha must therefore be wrong.
Answer: normative practice is a serious halakhic fact, especially for lemaase, practical conduct. But it does not make every proposed explanation historically or conceptually identical. Posqim prohibit through different models, at different legal levels, and with different nafqa minas.
The fact of practical prohibition can coexist with an analytic conclusion that one specific intrinsic theory fails. Rabi Shlomo Zalman's writings are the clearest example: strong attacks on blanket technical categories did not become an ordinary switching heter. Our task is not to erase practice. It is to state what each source proves.
Objection nine: even if every individual theory is doubtful, the accumulation of mavir, boneh, makeh bpatish, molid, and uvdin dhol creates an overwhelming safeq, doubt, requiring stringency.
Answer: practical doubt can indeed justify restraint, particularly where a deOraita, Torah-level prohibition, is plausibly involved. But aggregation cannot replace analysis. Five weak classifications do not automatically become one strong classification, especially when they contradict one another about the nature of the act.
Mavir says it is fire. Boneh says it is construction. Molid says it is a new rabbinic property. The legal consequences differ. For the academic question, each must be judged separately.
For practice, accumulated authority, custom, and risk may counsel stringency without proving that zérem is intrinsically a melakha.
Objection ten: your ideal case is unreal. Every current produces some heat, an electromagnetic field, and microscopic change. Therefore there is always an output.
Answer: halakha does not classify every microscopic physical consequence as a melakha. If negligible resistance heating made every current mavir, then the halakhic definition would be heat at any nonzero level, a proposition the classical sources do not support. Melakhet mahshevet and shiur, legally cognizable measure, require a humanly meaningful act and result. The ideal case abstracts away outputs with an independent halakhic identity. That is exactly what a conceptual test is supposed to do.
Objection eleven: once direct switching is permitted in principle, people will inevitably use appliances whose outputs are prohibited. The line is impossible to administer.
Answer: that may support a later gezerah-like policy only if an authorized halakhic category and authority exist for it. It does not retroactively turn current into fire or construction. Halakha frequently draws expert distinctions that ordinary practice handles through broad safeguards. One may maintain a broad practical rule while admitting that its reasons include confusion, device complexity, accepted pesaq, or shabaton rather than an intrinsic av melakha.
Objection twelve: the meqorist method is itself tendentious. The Talmud expects later sages to extend its categories, not demand exact textual duplication.
Answer: agreed, if source-bound means exact duplication, the method is wrong. Toldot necessarily extend. The real demand is qualitative resemblance and doctrinal control. Boneh can apply to new materials.
Kotev, writing, can apply to new media. Bishul can apply to new heat sources. But the new fact must share what makes the av what it is. A meqorist approach is most faithful when it permits principled development and refuses category by mood.
Part Twelve. the Case for heter, Stated Positively
The heter in this sugya is not a special dispensation for technology. It is a sequence of classifications.
First, zérem without spark, glow, or meaningful heat is not havarat esh. Therefore there is no mavir.
Second, the completed appliance remains a kli metuqan, a finished utensil, in its off state. The switch is installed for recurrent control. Introducing current is derekh tashmish rather than tiqun begufo shel keli. Therefore boneh is not established, and opening the switch is not soter.
Third, routine activation is not the final manufacture or repair of the object. In the absence of a significant perceptible result, it also lacks the creative completion that supports the broader Yerushalmi-based model. Therefore makeh bpatish is not established.
Fourth, current is a tran-zee-unt operating process, not a perceptible acquired property comparable in a close way to scent in material. The Gemara does not state a general ban on every new useful state. Therefore molid is at most a contested later rabbinic analogy, and in the ideal case the analogy is too weak to carry the prohibition by itself.
Fifth, uvdin dhol is contextual. Professional labor, commerce, heavy weekday production, conduct resembling melakha, and realistic pathways into melakha can all be prohibited. The motion of charge has no single weekday social form. Therefore electricity is not intrinsically uvdin dhol merely because it is electricity.
Put differently, the permissive analysis does not say nothing happened. It says the thing that happened has the legal form of tashmish bkli hamtukan, use of a completed utensil, through admission of a prepared physical flow. New utility is real, but new utility is not itself an av. The switch changes the operating state without building, finishing, kindling, or producing a Talmudically cognizable new property.
This conclusion is strongest in the artificial zero-output case. It also generates real nafqa minas in less artificial cases: changing the intensity of an existing current may be easier than creating a first current under molid; hidden automatic state changes may lack melakhet mahshevet; a physical repair of wiring may be boneh even when ordinary switching is not; incandescent heating may be mavir even when Led current is not; and professional electrical use may be uvdin dhol even when a medical or background current is not.
Part Thirteen. the Conclusion
We can now state the maskana, conclusion, with the necessary precision.
From the Gemara's melakha structure, hibur hamaagal hahashmali and hakhnasat zérem, standing alone in a fully assembled utensil designed for repeated activation, do not clearly instantiate any av melakha or tolda. Mavir fails because no esh or incandescent condition exists. Boneh fails because there is no construction or bodily repair, only selection of an operating state in a complete kli. Soter consequently fails.
Makeh bpatish fails because the act is ordinary use rather than gmar melakha, and our test case lacks the significant perceptible result needed by its broadest contemporary formulation. Molid remains the most historically developed rabbinic analogy, but its Talmudic sources do not establish a general prohibition on tran-zee-unt, imperceptible current in a device built to alternate states.
Uvdin dhol does not change that intrinsic melakha conclusion. It is a separate, contextual category. The explicit view that ordinary non-filament activation is no melakha but remains prohibited as uvdin dhol is best attributed to rabi Nahum Eliezer Rabinovitch, with rabi Yosef Eliyahu Henkin as an earlier source for the no-melakha premise.
It should not be presented as rabi Shlomo Zalman Auerbach's formal classification. And even within the Rabinovitch framework, electricity is not universally uvdin dhol; the human action and context must have that form.
Therefore, as a matter of intrinsic lomdus, the strongest meqorist conclusion is that zérem itself is not a melakha. The prohibition, where present, must come from a defined downstream result, a genuine physical construction or repair, a context-specific shevut, an accepted practical ruling, or another independent halakhic fact.
That is not a practical blanket heter for appliances. Real devices rarely remain inside our abstraction. They illuminate, heat, move, communicate, store, display, calculate, record, trigger remote systems, and interact with grids and sensors.
Muktzeh and other restrictions may also apply. Ordinary observant practice does not treat intentional direct switching as generally permitted. Anyone deciding an actual case needs a competent poseq who understands both the device and the sources.
But the conceptual conclusion should not be blurred because the practical world is complicated. If the question is only, is electrical current itself one of the melakhot, the answer yielded by the narrow Gemara analysis is no established melakha. Electricity is a medium. Halakha classifies the human act and the legally significant result.
And that, finally, is why the best one-line formulation of the sugya is not electricity is forbidden, and not electricity is permitted. It is this: zérem is not halakhically primary. The proposed shem melakha, legal identity of prohibited labor, must be proved in the switch, the circuit, the appliance, or the result. Where every such result has been removed, the current has not supplied the missing name.
